IRCC has announced a new update regarding the extension of a policy that allows foreign national visitors who have a job offer while in the country will be able to apply for, & receive a work permit.
The applicants should fulfill the following criteria to become eligible to apply for the policy:
- have valid status in Canada as a visitor on the day they apply
- have a job offer that is supported by a Labour Market Impact Assessment (LMIA) or an LMIA-exempt offer of employment
- apply for an employer-specific work permit no later than February 28, 2025
- meet all other standard admissibility criteria
A valid job offer is defined as a written offer of a full-time, non-seasonal job for one year or more if you are accepted as a permanent resident and must have a positive or neutral Labour Market Impact Assessment from Employment and Social Development Canada (or the job is LMIA-exempt).
LMIA is an application that is made by an employer to the Employment & Social Development Canada (ESDC) to evaluate whether the foreign workers will have a positive, neutral, or negative impact on the economy of the country.
If the department finds the impact negative then the employer becomes ineligible to hire the foreign nationals.
Before the change in the policy foreign nationals interested to work in Canada would need to apply for a work permit in the country before arriving.
This temporary public policy also provides the opportunity for applicants who meet these criteria and who had a valid work permit in the past 12 months to begin working for their new employer before their work permit application has been fully approved.
